You take privacy seriously, and so does SubMain. It's our way of sustaining your trust in SubMain as well as in our products and services.
Personal Data We Collect
A user account on our web site contains certain private and public personal information that is reasonable and expected in maintaining a product supplier to customer relationship. The user account is only created when you perform specific form-submitting actions on our web site, such as downloading a free product evaluation, purchasing licenses, etc. We do NOT collect any personal data considered to be of a sensitive nature such as religious or political affiliation.
The user account contains private information, which includes your full name and e-mail address. This data is required since your e-mail address is used as the login mechanism for your account and the name is how you are identified to us.
After ordering a SubMain product or service, you may be associated with an organization account. The organization account represents a company, organization, or individual who has purchased product licenses or services. Organization accounts track the organization's name, postal address, phone number, and SubMain purchase history. They also track one or more user account contacts who have access to the organization account. When added to an organization account, other contacts for that account will be able to see your name and e-mail address in the contacts list. Organization account information can be edited from the organization account page.
Certain portions of our web site may track your IP address, which helps us prevent against fraudulent orders.
Other private data that is only accessible to SubMain and never shared:
- Downloads - any product downloads that you've made, allowing us to follow-up after an evaluation period.
- Mailing list subscriptions - any mailing lists for which you've requested and/or confirmed a subscription.
- Poll responses - any polls that you've answered.
Lawful Basis for Processing Personal Data
We rely on a number of lawful bases to use your personal data:
- Legitimate Interests - used for most processing of personal data since it is required for us to manage and promote our business and may include, but is not limited to: maintaining a business relationship with our customers and potential customers, gaining insights into how our products are being used, exploring how to grow our business, providing customer support, improving product and web site reliability, maintaining data and network security, and guarding against fraud.
- Contract - used when a customer has ordered products or services, and requires access to product downloads/licenses and appropriate customer support.
- Legal - used when processing is necessary for us to comply with the law.
- Consent - used for newsletter communication where an opt-in is required. Consent can always be revoked.
Anonymous/Non-Personal Data
In general, you can visit SubMain websites or use our products without telling us who you are or revealing any information about yourself.
Our websites and products collect and store anonymous information about your visit on an aggregate basis. This information includes but is not limited to: the time and length of your visit, the pages you look at on our sites, the site you visited just before coming to ours. We may also record the browser type, and country of origin. We use this information only to measure site activity and to develop ideas for improving our sites and products.
Our desktop applications may collect anonymous information about your use of the application to aid us in planning future improvements. Such information includes technical information about your computer such as the software versions as well as information about which features of our applications and services you use and the length of time you use such features. Should you encounter errors in use of the application, the application may report such errors along with information about what activity you were performing at the time. All such data are collected and transmitted anonymously.
We collect this information both directly and via use of third party services such as Drip and Google Analytics.
Information You Provide
We ask you to register or login to your account in certain circumstances, including for example, when you download trial or free software, sign up for newsletter services, download patches, purchase software, register software, use our support forums or join a limited-access premium service. As part of the registration process, we collect personal data from you in order to provide service and to validate your access to your purchased products and our forums. Information we collect from you includes personal data, such as name, e-mail address, mailing address, company name, and phone number ("Personal Data"). If you purchase products through our ecommerce site, we do not retain and store your credit card information.
Information Acquired From External Sources
SubMain Marketing conducts outbound marketing campaigns to reach new customers. The source of the contact information, their Personal Data, comes from trade shows where contact information is voluntarily provided, webinar registrations, publicly available sources such as LinkedIn and purchased lists from companies. The processing of personal data for direct marketing purposes is carried out for a legitimate business reasons. Only contacts who respond positively to the marketing content or who explicitly request to Unsubscribe are maintained in the marketing system. Those who do not respond to contact attempts are deleted from the system in 180 days after the first contact.
Information Associated With You
When you purchase a product, we provide you with a product license or other authorization mechanism to access to the purchased product. We maintain this information to prevent fraud and authorize access to the products you purchased as well as support services associated with your level of purchase. We provide access for you using this personal data through a customer portal service on our website for you to renew your subscription, and obtain access to your purchased products.
If you purchase products through our ecommerce facilities for one year or recurring subscriptions we do not retain your financial information. Recurring subscription authorization is maintained by a PCI-compliant payment processor in encrypted form that does not retain credit card information.

How We Use Collected Information
We may use collected Information for several purposes:
- We may use your Personal Data to process your transactions.
- We analyze collected Information to better understand your needs and interests in order that we may improve our service to you.

- as necessary to protect the rights, safety, or property of SubMain, its users, or others; this may include (for example) exchanging information with other organizations for fraud protection and/or risk reduction.

Marketing Communication
You will receive product and services information, special offers, and general marketing material as a customer or interested party of SubMain's products and services. If you don't want SubMain to send you e-mail or postal mail regarding SubMain' products, services, or special offers, you may unsubscribe at any time. Unsubscribe links to eliminate further email communications are available on all e-mail communication material. You can also add your email address to our 'stop list' to remove yourself from our marketing communication using this link.
For SubMain product owners, Trial users, or webinar registrants, some material is not subject to Unsubscribe such as communication related to product downloads, sales transactions, trial requests, software updates, support related information, software patches, fixes or responses to support issues, confirmations for webinars, disclosures to comply to legal requirements and quality assurance surveys.
Your Data
Our applications may store your data locally on your device, for the purpose of improving the performance of the application. Where we do store such data, it is stored securely.
If you choose to use our support services, you may post information on our support forums or submit information at your discretion in order to more fully describe a problem. Such information may include files containing data or programs. Information that you post on the support forums is publicly available to those who have access to the forums and it is your responsibility to ensure it does not contain personal or sensitive information.
If you choose to use our support/sales Help Desk via email, you may provide information in your email or submit information at your discretion in order to more fully describe a problem. Such information may include files containing data or programs. Information that you submit to our Help Desk via email is NOT available publicly and can be reviewed by you using a unique secure personal link.
We do not transmit or otherwise use your data for any purpose other than fulfilling the service. We do not transfer your data to third parties.
Revision of Personal Data
SubMain retains minimum Personal Data that is reasonable and expected in the management and maintenance of a product supplier to customer relationship.

Retention and Deletion of Personal Data
SubMain will retain your Personal Data for as long as your account is active; as needed to provide you products or services; as stated in the Terms of Use agreement; as needed for the purposes outlined in this policy or at the time of collection; as necessary to comply with our legal obligations, honor UNSUBSCRIBE requests, resolve disputes, meet financial audit requirements and enforce our agreements; or to the extent permitted by law.
If requested, SubMain will delete your Personal Data in a manner designed to ensure that your identify cannot be reconstructed or read. A deletion request may not result in the complete deletion of your data. Purchase information will be maintained for legal and financial audit purposes. Forums submissions will be retained as per the Terms of Use Agreement and your name will be removed. If you wish to remove your Personal Data, send mail to privacy@submain.com with subject "Remove My Personal Data" and state your need and contact information.
Personal Data Transfer, Processing and Storage
We process and store data about you on servers located in a number of countries. Your Personal Data may therefore be transferred to, using appropriate security protocols, processed and stored in a country different from your country of residence, and be subject to privacy laws that are different from those in your country of residence. The Personal Data that we store is not highly sensitive and is required to conduct normal and expected business practices. Specifically, Personal Data, as described in this policy, is stored on US-based data servers or in Cloud Storage Services managed by US and International companies. We and all third party companies with which we engage with have committed to complying with the 2018 EU GDPR privacy regulation for EU residents. Based on the Lawful basis definition, as defined by the EU GDPR regulation, SubMain's use and storage of minimal Customer Personal Data, the Legitimate Interests basis is the appropriate legal basis of data storage and use. It is a reasonable and expected use of customer and prospective customer data.
Changes to This Privacy Policy
We may revise this Privacy Policy from time to time by posting a revised Privacy Policy on our website and changing the last modified date at the top of the Privacy Policy. If we make significant changes to the Privacy Policy, we will contact you by email (when available). We reserve the right to modify this Privacy Policy at any time, so please review it frequently.
